Please read these terms and conditiones ("Terms") carefully before using the weather app provided by Meteosource ("Service") which is operated by IFYS, Ltd ("Company"). By using the weather app, you accept the Terms in effect at the time of use, which apply upon publication at meteosource.com or in the corresponding app.
The Company reserves the right to change these Terms at any time. The Terms are published in their current form. If the Service is used on a recurring basis, it is recommended that the Terms are accessed on a recurring basis.
All rights in the content and software which are made available via this Service including, without limitation, the design and arrangement of such content and software (the "Content") are owned, controlled or licensed by or to the Company and are protected by all applicable international intellectual property laws.
The company grants you a non-exclusive right to use the Service, which is limited to the time period when the information is actually provided and the Intended Use. The "Intended Use" is to obtain the Information for your own private or occupational purposes as long as the use is not for commercial exploitation of the Information. The Intended Use does not include – copying some or all of the Information to create or expand one’s own databases or to provide an Information Service, and for all purposes that run counter to the interests of the Company. In addition, any use of the Service that can damage, overload or otherwise impair the functionality of the Service and any use for illegal, unauthorized purposes or immoral purposes is not permitted.
These Terms in the original version are written in the English language. In the event of inconsistency regarding the translated version, the English version shall apply.
The Company shall provide its Services in accordance with the recognised rules of meteorological science and technology. However, due to the numerous factors that influence the weather, actual weather conditions cannot be reliably forecast in all cases. Likewise, it is not always possible to fully understand weather conditions in retrospect. Rather, the Information are forecasts based on experience with certain probabilities. Deviations from actual weather conditions cannot be avoided. Therefore, The Company assumes no liability of any kind towards users and third parties affiliated with them in connection with any failure of the meteorological data to match the weather conditions actually occurring.
The Company shall have no liability to the Customer under the Terms if it is prevented from or delayed in performing its obligations under the Terms, or from carrying on its business, by acts, events, omissions or accidents beyond its reasonable control, including, without limitation, strikes, lock-outs or other industrial disputes, failure of a utility service or transport or telecommunications network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of meteosource or sub-contractors.
